El marco jurídico de la Red Vial Cantonal (RVC) en Costa Rica, se ha encontrado en constante avance. Sin embargo, en la actualidad enfrenta problemas que van más allá del solo ámbito legal. En este sentido, la importancia del análisis de la RVC como competencia constitucional y legamente atribuida a los Gobiernos Locales, revierte de gran interés. La transferencia de la competencia sobre la RVC debe ser completa, no solo un mandato que se limite a letra muerta; por lo que se requiere generar un acompañamiento integral tanto en lo jurídico, económico, social y ambiental. Además de un régimen de financiamiento fuerte y justo, junto con la protección constitucional de los recursos asignados, aunado a una óptima gestión de la red mediante el involucramiento efectivo de los distintos actores participantes y la correcta gestión de los PVQCD; y es con base en ello que pretende incursionar esta propuesta investigativa.
Inglés: The legal framework of the cantonal road network (CVR) in Costa Rica has been in constant progress. However, it currently faces problems that go beyond the legal realm alone. In this sense, the importance of the analysis of the RVC as a constitutional competence and legally attributed to Local Governments, reverts of great interest. The transfer of competence over the CVR must be complete, not just a mandate that is limited to a dead letter; so it is necessary to generate a comprehensive accompaniment both legally, economically, socially and environmentally. In addition to a strong and fair financing regime, together with the constitutional protection of the allocated resources, coupled with optimal network management through the effective involvement of the different participating actors xvii and the correct management of the PVQCD; and it is on this basis that he intends to venture this research proposal.
